Official Rules of the Conner Prairie 1859 Balloon Voyage VIP ride with Olesya Rulin from High School Musical Sweepstakes
I. Conner Prairie and Radio Disney of Indianapolis, Indiana
II. ELIGIBILITY
Sweepstakes are open to all legal United States residents age 14 years and younger as of July 24, 2009.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Conner Prairie Museum, Inc., Conner Prairie Foundation, Inc., 1859 Balloon Voyage, LLC, Radio Disney, Rickers Oil Inc., any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year. Limit one entry per household.
Winners must be willing to go up in the 1859 Balloon Voyage for VIP ride and meet and greet with High School Musical’s Olesya Rulin artist. Balloon goes up to 350 feet in the air. Entrant's parents must consent to balloon ride and agree to sign waiver of liability.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY.
Enter on-line at www.connerprairie.org; pick up an entry form; enter at participating BP am/pm stores within the Indianapolis, IN area; enter on specified days at the Indiana State Fair or pick up an entry form and enter at Conner Prairie, 13400 Allisonville Road, Fishers, IN 46038. Go to www.connerprairie.org for participating BP am/pm store locations and specified dates for entering at the Indiana State Fair. Entries will be accepted online at connerprairie.org or via entry form at participating BP am/pm stores within the Indianapolis area beginning July 24, 2009, through 11:59 pm ET August 13, 2009 ("BP Entries"). Enter via entry form at the Indiana State Fair Conner Prairie booth on August 12 and August 13, 2009 ("State Fair Entries") from 10:00 am ET to 10:00 pm ET. Enter via entry form at Conner Prairie beginning July 24, 2009, through 11:30 a.m. ET August 15, 2009 ("Conner Prairie Entries"). Sponsor's server is the official clock for the promotion.
Entries remain the property of Sponsor and will not be returned or acknowledged.
Limit one entry per household.
Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this sweepstakes. In the event of a dispute over an electronic entry, prize will be awarded to the owner of the e-mail account, not the name on the entry form.
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
A total of 10 winners will be selected from all entrants, 5 winners will be selected from online entries, BP Entries, Conner Prairie Entries and State Fair Entries. Five winners will be selected from BP Entries, State Fair Entries, and Conner Prairie Entries. The 5 winners from the online entries, BP Entries, Conner Prairie and State Fair Entries will be chosen via a random selection process conducted on August 14, 2009, and will be notified, via telephone, on August 14, 2009. The winners must call Conner Prairie to acknowledge their selection and accept the opportunity to participate in the balloon ride by a set time as directed in the telephone call from Conner Prairie or an alternate winner may be selected. Winners selected from online entries, BP Entries, Conner Prairie Entries and State Fair Entries must agree to attend the Olesya Rulin appearance at Conner Prairie on August 15, 2009, and must be determined to be eligible in accordance with these rules.
Up to 5 winners will be chosen from BP Entries, State Fair Entries, and Conner Prairie Entries will be selected by random drawing conducted at 12 pm ET August 15, 2009, at Conner Prairie, 13400 Allisonville Road, Fishers, IN 46038 ("Conner Prairie Drawing"). Winners chosen during the Conner Prairie Drawing must be present to win. Winners from the Conner Prairie Drawing will be announced at the Radio Disney tent located outside Conner Prairie's welcome center (does not require general admission) and at the Radio Disney tent within Conner Prairie grounds which requires general admission at $12 per adult; $11 for seniors 65+; $8 per youth (ages 2-12); free for Conner Prairie members and youth under 2. Winners will be announced, as drawn at the Conner Prairie Drawing. Up to 15 names will be selected until 5 winners who are present are selected. If 5 winners are not present and eligible after the first 15 names are drawn during the Conner Prairie Drawing, no further names will be drawn and those entrants present and eligible will participate in the balloon ride. Sponsor will draw winning entries and those winners will be announced, in the order drawn, until 5 prize winners present at the location listed below come forward to claim the prize and are determined to be eligible in accordance with these rules. Winners will be directed to report to guest services to insure eligibility with these rules. Winners will receive general admission into Conner Prairie for the winner and the individual who will accompany the winner on the balloon ride.

V. PRIZE
Prize includes a VIP 1859 Balloon Voyage ride for two with Olesya Rulin from High School Musical (and other sweepstakes winners) which will last between 5 and 10 minutes, a VIP autograph and meet and greet session with Olesya Rulin. Winners age 12 and under must be accompanied by a parent or guardian. Winners age 13 and age 14 may bring a friend age 13 and older. Any friend, and the parent/legal guardian of the friend who rides the balloon with a winner, must agree to and sign the release of liability form.
The balloon ride will be conducted on August 15, 2009, and includes rising up to 350 feet in the air on a helium filled tethered balloon. Ride will last approximately 5-10 minutes and is weather dependent. A rain check for the balloon portion of the prize will be provided by Conner Prairie if balloon does not fly. Rain check prize includes two Conner Prairie general admission tickets and two 1859 Balloon Voyage tickets and can be redeemed at a later date during Conner Prairie’s operating hours, but Olesya Rulin will not be present on alternate dates. Balloon ride is weather dependent. If the balloon ride does not occur on August 15, 2009, the sweepstakes winners will still participate in a VIP autograph session and meet and greet session with Olesya Rulin.
All expenses not specifically provided for herein are the winner’s sole responsibility. Some restrictions may apply.
Transportation to and from Conner Prairie is the responsibility of the winner and any guest of the winner.
Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.
Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.
The prize will be awarded in parent’s or guardian’s name.
Prize is subject to availability. Sponsor is not responsible for cancellation or preemption of show/contest/event/meeting or for other circumstances that make it impractical or impossible to fulfill this element of the prize, including the weather. This element of the prize has no approximate retail value, and if it becomes impractical or impossible to fulfill this element, Sponsor’s only obligation will be to provide the remainder, if any, of prize.
VI. RELEASES
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor and the sweepstakes administrator, which shall be final in all respects.
By participating in this sweepstakes and accepting any prize that they may win, entrants agree to release Conner Prairie, Radio Disney and Rickers Oil Inc. their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this sweepstakes and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
By entering the contest, the entrant, and entrant's parent/legal guardian, agree (a) to these rules and decisions of Sponsor which shall be final and binding in all respects and in all matters relation to this promotion; (b) to release, discharge, indemnify and agree to hold harmless Sponsor, its advertising and promotion agencies and all of their respective parents, affiliates, subsidiaries, agencies, agents and representatives and all of their respective employees, officers and directors from any liability or responsibility whatsoever for any claims, costs, injuries, losses or damages (whether due to negligence or otherwise) of any kind (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss of or destruction of property, or rights of publicity or privacy), arising out of or in connection with the promotion or from their acceptance, possession, use or misuse of any prize, or participation in the promotion or any promotion related activity. In no event will Sponsor, its advertising and promotion agencies and all of their respective parents, affiliates, subsidiaries, agencies, agents and representatives and all of their respective employees, officers and directors be responsible or liable for any damages or losses of any kind, whether direct, indirect, incidental, consequential, punitive or other damages.
To claim prize: (a) winner must provide proof of age, identity and residency; (b) winner and winner's parents and/or legal guardians must sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification; and (c) winner’s intended guest(s) or travel companion(s), if any, must sign liability/publicity release, all within the time period specified by Sponsor.
If a winner is found to be ineligible or not in compliance with the official contest rules, winner will be disqualified, the prize forfeited and an alternative winner will be selected. If the winner or the winner's parents/legal guardians do not execute the affidavit of eligibility/compliance with rules, publicity/liability release and indemnification winner will be disqualified, the prize forfeited and an alternative winner will be selected.
VII. MISCELLANEOUS; WINNERS’ LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
Entrants and entrant's parents/legal guardian agree that (a) any and all disputes, claims, and causes of action arising out of or connected with this promotion, or any prize awarded, or the determination of the winner, shall be resolved individually and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective and (b) any and all claims, judgments and awards shall be limited actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorney's fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of entrant and/or Sponsor in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of Indiana without regard for conflicts of law doctrine, and all proceedings shall take place in the State of Indiana.
